General Terms and Conditions

1. Applicability

1. These general terms and conditions apply to all quotations, orders and agreements of Botekt, unless otherwise agreed in writing.

2. By placing an order, the client agrees to these terms and conditions.

2. Quotations

1. All quotations are without obligation and valid for a period of 30 days after the date, unless otherwise stated in writing.

2. An agreement will only be concluded after the quotation has been confirmed in writing or by e-mail by the client.

3. Changes or additions are only binding if confirmed in writing by Botekt.

3. Prices and payments

1. All prices are exclusive of VAT and any additional costs, unless stated otherwise.

2. Payment must be made within 14 days after invoice date, unless otherwise agreed in writing.

3. At the start of the project, Botekt can charge a deposit of 25% of the contract sum desire.

4. Installment invoices are related to the progress and value of the work already completed.

5. If the payment term is exceeded, the client is legally in default and is statutory interest due. If the client is a consumer, the statutory interest rate applies; if the client acts in the exercise of a profession or business, the statutory commercial interest rate applies.

6. All extrajudicial collection costs shall be borne by the client, in accordance with the Decree on compensation for extrajudicial collection costs (BIK).

4. Execution of work

1. Botekt carries out the work to the best of its knowledge, expertise and craftsmanship.

2. Delivery dates are indicative and are not binding, unless otherwise agreed in writing.

5. Cancellation and changes

1. In the event of cancellation by the client after acceptance of the quotation, Botekt is entitled to charge the costs already incurred, with a minimum of 10% of the quoted price.

2. If cancellation takes place within 14 days prior to the planned start date, Botekt is entitled 25% of the contract sum to charge.

3. If work has already commenced, Botekt is entitled to invoice the full contract sum.

4. Changes to the order may lead to adjustments in price, planning and delivery times.

6. Liability and warranty

1. Botekt is only liable for direct damage that is the direct result of an attributable shortcoming in the performance of the agreement.

2. Any liability of Botekt is limited to the invoice amount of the relevant assignment, with a maximum equal to the contract sum of that project.

3. Botekt is not liable for indirect damage, consequential damage or loss of profits.

4. Botekt grants a 10-year warranty on the roof covering construction installed by us and 3 years on sealing work, unless otherwise agreed in writing.

5. The warranty is void if damage is caused by: improper use, inadequate or overdue maintenance, modifications or repairs by third parties, damage due to external influences such as storm, fire, vandalism or construction errors in the building.

7. Complaints

1. Complaints about work carried out should be submitted as soon as possible, but within 30 days at the latest after discovery, must be reported to Botekt in writing.

2. Botekt will assess complaints and, if justified, resolve them within a reasonable period of time.

8. Retention of title

1. All materials supplied by Botekt remain the property of Botekt until the client has fully met his payment obligations.

9. Use of photos and reports

1. Botekt reserves the right to use photographs of the work and inspection reports for internal documentation and promotional purposes. This will be done without mentioning address or personal information, unless the client gives explicit permission.
   
   
2. The client can object in writing to the use of photos or reports.

10. Construction and existing defects

1. The necessary slope is assumed to already be present in the existing roof structure. Botekt bears no responsibility for persistent puddles or other consequences of the original construction and construction of the building.
   
   
2. Botekt carries out no changes or repair work on the building subsoil or supporting structure, unless this has been expressly agreed in writing.
   
   
3. Any defects or shortcomings in the existing construction are not covered by liability or warranty from Botekt.

11. Applicable law

1. All agreements are exclusively governed by Dutch law.
   
   
2. Disputes will be submitted exclusively to the competent court in the district where Botekt is established.
